I understand your concern. Let me explain our position. According to Article 5 of the contract, the design consultant is responsible for providing a complete and workable design. The issue we found affects the structural safety, so we require that you resolve this as part of your design responsibility.

We reviewed Article 5 carefully. However, the issue relates to the soil condition data you provided at the project start. Our design was based on that information. We believe this falls outside our original scope.

I appreciate your review. Let me point out that Article 5.3 requires the consultant to verify all input data and report any concerns before finalizing the design. We did not receive such a report from your side. Therefore, we expect you to take responsibility and provide a solution within 2 weeks.

That is a valid point. We should have flagged the data issue earlier. How about this: we will prepare a revised design to resolve the structural concern. However, we request a 10 percent increase in the design fee to cover the additional work. Can we agree on this approach?

Please provide your analysis and revised design proposal by next Friday.
